1. TERMS AND CONDITIONS
1.1 Introduction
These Terms and Conditions ("Terms") constitute a legally binding agreement between Daastan Productions ("Company," "we," "us," or "our"), a photography and cinematography production house operating under the brand name Daastan Productions / Daastan Films, with its principal place of business in the National Capital Region (NCR), India, and you ("Client," "you," or "your"). By accessing our website, submitting an inquiry, making a booking, or entering into any service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.2 Services
Daastan Productions offers professional services including Wedding Photography, Pre-Wedding / Engagement Photography, Cinematography and Wedding Films, Candid and Portrait Photography, and Event Coverage. The scope, deliverables, timelines, and pricing for each engagement shall be governed by the specific Service Agreement / Booking Contract executed between the parties.
1.3 Booking and Confirmation
A booking is considered confirmed only upon receipt of the advance/retainer fee and the execution of a signed contract. Verbal confirmations, WhatsApp conversations, emails, or social media messages alone do not constitute a binding booking. We reserve the right to decline any booking at our sole discretion prior to formal contract execution.
1.4 Payment Terms
Standard payment structures involve a non-refundable retainer at booking and the remaining balance due before or on the day of the event. All payments are in Indian Rupees (INR). Failure to complete payment may result in suspension or cancellation of services without liability to Daastan Productions.
1.5 Cancellation and Rescheduling
Cancellations must be in writing. Retainers are strictly non-refundable. Cancellations within 30 days of the event may attract charges up to the full contract value. Rescheduling is subject to availability and may attract fees if requested within 30 days of the original date. In rare cases where we cannot fulfill a booking, we will attempt to find a replacement or refund amounts beyond the retainer.
1.6 Deliverables and Timelines
Edited content shall be delivered within the timeframe specified in the Service Agreement. Raw/unedited files are not part of any deliverable and shall not be shared. Deliverables are provided via digital delivery unless otherwise specified.
1.7 Client Conduct and Cooperation
The Client must ensure reasonable access to venues and subjects. We are not liable for missed moments or limited coverage arising from external factors such as venue lighting, weather, or restricted access.
1.8 Force Majeure
Neither party shall be liable for failure to perform due to causes beyond reasonable control, including acts of God, pandemic, natural disasters, or government orders.
1.9 Governing Law
These Terms are governed by the laws of the Republic of India. Any disputes shall be subject to attempt at good-faith negotiation, followed by the exclusive jurisdiction of competent courts in New Delhi, India.
2. PRIVACY POLICY
2.1 Introduction
We are committed to protecting your privacy in compliance with the Information Technology Act, 2000, and informed by the Digital Personal Data Protection Act, 2023.
2.2 Information We Collect
We collect contact information (name, email, phone), event details, payment transaction references, communication data, and technical usage data.
2.3 How We Use Information
Data is used to respond to inquiries, process bookings, deliver media, send administrative notifications, and comply with legal obligations. We do not share your data with third-party advertisers.
2.5 Image and Media Privacy
By engaging our services, you grant us the right to use select images/clips for portfolio and promotional purposes, unless you explicitly opt out in writing prior to the Service Agreement. A privacy surcharge may apply for full confidentiality.
2.7 Data Security
We implement reasonable technical measures to protect your information, though absolute security over the internet cannot be guaranteed.
3. INTELLECTUAL PROPERTY
3.1 Ownership
All creative content produced by Daastan Productions remains our exclusive intellectual property under the Copyright Act, 1957 of India.
3.2 License to Client
Upon full payment, Clients are granted a non-exclusive, perpetual personal license for non-commercial use (printing, personal social media sharing).
3.3 Restrictions
Clients may not sell, commercially exploit, or materially alter/edit the delivered content without our written consent. Watermarks must not be removed from previews.
4. DISCLAIMER
4.1 Accuracy
Website content is for general information. We make no warranties regarding completeness or accuracy.
4.2 Liability
We are not liable for indirect or consequential damages, or loss of data due to events beyond our control. Our total liability is limited to the fees paid for the specific engagement.
5. REFUND POLICY
5.1 Retainers
Retainer fees are strictly non-refundable and serve as consideration for exclusively reserving your date.
5.3 Quality and Style
No refunds shall be issued based on subjective dissatisfaction where the work is consistent with our publicly available portfolio.
